A Nairobi court has delivered a significant judgment in a defamation case, ordering Kenyan blogger Edgar Obare to pay a total of Ksh. 6 million in damages and issue a public apology to model Bernice Nunah and a co-plaintiff, Kelvin Kaume Maingi.

The ruling, which stems from a post published in 2022, emphasizes the severe legal repercussions for defamation in the digital age.

The verdict was handed down by Hon. Hosea Mwangi Nganga on November 7, 2025, in Civil Case No. E6364 of 2022. The court awarded the plaintiffs a substantial sum in damages, categorized as follows:

Damage Type Amount per Plaintiff Total Awarded
General Damages (Libel) Ksh. 2 million Ksh. 4 million
Exemplary and Aggravated Damages Ksh. 1 million Ksh. 2 million
Grand Total Ksh. 3 million Ksh. 6 million

In addition to the financial penalty, the court imposed non-monetary directives, compelling Obare to:

  1. Issue a full and unqualified apology.
  2. Make amendments and withdraw the defamatory publication dated December 22, 2022.
  3. Comply with a permanent injunction restraining him from any further publication of defamatory content against Nunah.

Bernice Nunah is a commercial model who gained national attention after being named the second runner-up for the Miss World Kenya title (2019-2021). She is also an entrepreneur and content creator specializing in luxury lifestyle, fashion, and travel.

Edgar Obare is a Kenyan blogger and content creator who publishes content on his Instagram account, and on his BNN web and Telegram platform. He has been sued before for his content but this is the first time one of the cases has been successful.

The ruling serves as a stark reminder to online content creators and bloggers about the legal liability associated with publishing unsubstantiated or malicious claims.
